Personal data

You alone decide whether or not to provide us with your personal data, e.g. as part of a registration process or contact enquiry. In general we will use your personal data to help us answer your enquiry, process your order, or give you access to special information, products or services.

When you register, submit a contact enquiry, etc., you may voluntarily make personal data available to us. This may mean we have to communicate your data to a Group member company. Your data is not shared with third parties outside the Group unless this is expressly required under the terms of your enquiry or the product or service you request. You will be advised of this at the appropriate point. If you wish, you can also provide us with personal data via applications incorporated in our platform (e.g. contact forms or services for which you need to set up a user account). The use of these applications may be subject to conditions that differ from this Privacy Information. We will expressly draw your attention to this by way of additional privacy clauses. Art. 6 para 1 (b) of the EU General Data Protection Regulation (GDPR) serves as the legal basis for the processing of personal data for the performance of a contract to which you are a party. Cases in which we need to obtain the consent of the data subject to process his or her personal data are governed by Art. 6 para 1 (a) GDPR.

General information

If you access our websites or view a file, data relating to this process will be stored in a log file on our web server. Apart from your IP address, this data is not linked to you personally. We therefore cannot identify which user viewed which data. But if you access our website, data transmitted to us by your browser is automatically gathered and stored.

This involves the following data:

• The domain name of the website you came from
• The websites that you visited in our system 
• The names of the files you viewed
• The date and time you viewed a file
• The name of your Internet Service Provider
• And your PC operating system and browser version, as appropriate
• The host name of the accessing computer
• Language settings

This data is collected for security and/or statistical purposes and to optimise our Internet presence. This data is not attributed to specific people, and is not associated with other data sources. Data is saved for six months and then deleted. Your data is not disclosed to third parties. In exceptional cases we may be obliged to release personal data only when ordered to do so by the competent authorities, if required in order to avert a risk, for law enforcement purposes or for other reasons as determined by the law.

IP addresses

We deliberately avoid logging IP addresses in clear text when you use our websites. Before being saved in our web server log file, your IP address is pseudonymised using a process that complies with privacy requirements. We use the pseudonymised IP addresses to identify and counter attacks, for example, or to draw up web statistics.

Web analysis and web optimisation using Cookies and tracking pixels

We use Cookies and tracking technologies on our websites. These are used to optimise our website, to refine our services and for marketing purposes. The following describes these technologies and how they work.

When you visit one of our websites, we store information on your computer in the form of a cookie, which we automatically recognise on your next visit. Cookies are text files that are stored either in your web browser, or by your web browser on your computer. Viewing a website may store a cookie on your operating system. This cookie contains a characteristic sequence of characters that enable the browser to be clearly identified when the website is viewed again.

Using cookies helps us to give you unrestricted use of our website. They let us ensure your visit to our website is as convenient as possible. For example, they help us to adapt a website to your interests, or save your username to avoid the need to enter it again every time you visit.

We also use tracking pixels on our website. Tracking pixels are small graphics on websites that enable log files to be recorded and analysed. When you visit a website, tracking pixels record information in the cookie file in your browser. Using pixels lets us show you targeted information and content.

Children

Unless they have permission from their parents or guardians, children should not submit personal details to RWE websites. RWE recommends that all parents/guardians instruct their children about how to deal safely and responsibly with personal details on the Internet. In any case, RWE will not deliberately collect personal details of children or in any way use or disclose such information to third parties without authorisation.

Security

RWE has procedures in place to guarantee the security of your personal data. All efforts are made to protect your data against loss, destruction, forgery, manipulation, unauthorised access and unauthorised disclosure.

Links to other websites

RWE websites contain links to other websites. As the provider of our websites, we are solely responsible for the content of our own online presence. Our own content must be distinguished from content created by other providers, for which we cannot assume responsibility or ownership. We have no control over whether the linked website operators comply with the relevant privacy regulations. This Privacy Information therefore does not apply to websites of other providers, even if you view them via links on our website. Your attention is drawn to the privacy provisions of the other providers in each case. No liability on our part will be assumed for the content of third-party websites. Please advise us if you discover any relevant violations. We will inspect the links and remove them as appropriate.

Corporate presence in social media (fan pages on Facebook, Twitter, Flickr, Xing, LinkedIn and Youtube) and Google Maps

By ensuring a presence for our company on social media channels, we aim to communicate actively with you and give you the opportunity to learn about our products and services in this way.

Please note that we cannot rule out the possibility that your personal data will be processed in countries outside the European Union in such cases. As a result, it may be more difficult to enforce rights in certain circumstances, which represents a risk for the individual user. 

Visiting any of these corporate social media presences will generally result in cookies being stored on your computer. These cookies record patterns of use and user interests. The data obtained from these cookies is generally used for market research and advertising purposes, to enable advertising to be shown that is most likely to correspond to your interests as the user, based on observed usage patterns. 

Facebook “Insights” enable us to view statistical data in different categories via our Facebook page. These statistics are generated and made available by Facebook. As the operator, we have no influence over how these statistics are generated or displayed. We cannot deactivate this function or prevent data from being generated and processed. Facebook makes the following data available to us based on our Facebook page for a period of our choice, for the categories of fans, subscribers, people we have reached and people who have interacted with our posts:
Total number of page views, “like” information, page activities, post interactions, reach, video views, post reach, comments, shared content, responses, proportion of men and women, country and city origin, language, views and clicks in the shop, clicks on route planners, clicks on phone numbers.  It also provides information about the Facebook groups linked to our Facebook page. Because Facebook is under constant development, the availability of data and how it is processed are subject to change. We therefore refer you to Facebook’s Privacy Policy (https://www.facebook.com/policy.php) for further details. We use this data in aggregate form to make our posts and activities on our Facebook page more attractive to users. To this end, we have reached an agreement with Facebook on the “Page Insights Supplement” regarding the data controller. 

We process your personal data on the basis of our legitimate interest in communicating with you in accordance with Art. 6 para 1 (f) GDPR. You may also be asked by the provider of the social media in question for consent to the processing of your data. 

We have no influence over the data collected by the provider of the social media in question or the data processing operations it uses, nor do we know the full extent of data collection, the purposes of processing, or the storage periods. We also have no information on the deletion of data collected by the various providers. Accordingly, we draw your attention to the fact that the rights of persons concerned must be asserted against the provider, since only the provider ultimately has direct access to the data collected and is able to take appropriate measures and provide information. Any enquiries addressed to us will therefore be forwarded to the provider.

Our website also includes embedded map content from Google LLC’s Google Maps service via an API. To be able to display this content in your browser, Google must receive your IP address and location data, since it would otherwise be unable to deliver this embedded content. The provider of this service is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The parent company is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The privacy level for data processing in the USA is guaranteed on the basis of the Privacy Shield. The legal basis for data processing is Art. 6 para 1 (a) GDPR. For such processing, our collaboration with Google is based on a joint controller arrangement in accordance with Art. 26 GDPR, which may be viewed here. Further information on data processing by Google is may be found in Google’s Privacy Policy.

Sending of newsletters

We offer you the option of subscribing to our newsletters on our website and via embedded frames on our social media platforms. If you have given your consent to receiving the newsletter in question, we will use your e-mail address and your first name and surname to send information (customised where possible) about the RWE Group. We store and process this data for the purpose of sending the newsletter.

Newsletters contain information about the RWE Group. Current newsletters include the following in particular:

• Investor Relations newsletter
• RWE AG newsletter
• Job Alert newsletter

The legal basis for the data processing described above is your consent in accordance with Art. 6 para 1 (a) GDPR.

We use the double opt-in procedure to ensure that no errors are made when your e-mail address is entered. Once you have entered your e-mail address in the registration field we will send you a confirmation link. Your e-mail address will only be saved in our mailing list once you have clicked on this link.

You can withdraw your consent to receiving the newsletter in question at any time with future effect, e.g. by unsubscribing from the newsletter on our website. You can find the link to the unsubscription page at the end of each newsletter. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

If external processors are appointed to send the newsletter, they shall be bound by contract in accordance with Art. 28 GDPR.

Questions and comments

You have the right to obtain information from us without charge regarding your saved personal data, and to object to the processing or use of your data. You also have the right to complain to a supervisory authority. You are free to contact the competent supervisory authority of the State Commissioner for Data Protection and Freedom of Information North Rhine-Westphalia (Postfach 20 04 44, 40102 Düsseldorf) on data protection issues.
